So, he acted on an non-public information based on what he heard on sqwack radio service. Downgrade report is still not published but he has acted on the information front running others. So, this is a violation.
Do you mean to say that, Garcia needs to ensure that information is accessible in the public domain after it broke out on radio service? If she can’t find that information on public platforms or company website then he/she can’t trade on it.
