Hi,
Will you mind posting pic again as I am not able to see the full picture. M not able to read first question.
Thanks.
Sir actually I have problem in ques (ii) as I read this ques in two books both have exact opposite conclusion as one said she can sue shopkeeper as per general offer and can be accepted by anyone but in another book that she can’t sue shopkeeper as it is just invitation to offer.
Hi Ridhi,
In the given case she cannot sue shopkeeper as the display of dresses if just an invitation to offer and not actually an offer. I hope this answers your questions.
And just to add on, if by looking at the display if she would have gone inside and asked shopkeeper to show such type of dresses and in response to it shopkeeper showed her dresses in that case it would have been an offer.
Ok sir thanku so much 😊
No, Ms. lovely can not sue the shopkeeper for refusal .
In the given situation the shopkeeper has just made an invitation of offer and not an actual offer.
placing a price tag and showcasing the dress is an indication that the dress is available for sale, you can apply for the same ,but the ultimate decision to sell or not rests with the shopkeeper.
Hence, being the actual offer made by Ms.lovely the shopkeeper has a right to refuse acceptance and cannot be sued for that.
